Acceptance of These Terms
These Terms of Use ("Terms") are a binding agreement between you and OT Bestie, LLC ("OT Bestie," "we," "us," or "our"). By accessing or using our websites, applications, dashboards, study tools, tutoring services, reward programs, institution features, content, software, or related services (collectively, the "Service"), you agree to these Terms and to our Privacy Policy.
If you use the Service on behalf of an institution, company, program, or other organization, you represent that you have authority to bind that organization, and "you" includes both you and that organization. If you do not agree to these Terms, do not access or use the Service.
We may update these Terms from time to time. When we make material changes, we may provide notice through the Service, email, or other reasonable means. Your continued use of the Service after the effective date of an update means you accept the updated Terms.
Eligibility, Registration, and Account Security
The Service is intended for users who are at least 18 years old. You may not use the Service if you are under 18, if you are barred from using the Service under applicable law, or if we previously suspended or terminated your account for cause.
You agree to provide accurate, current, and complete account information and to keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must promptly notify us at contact@otbestie.com if you suspect unauthorized access, account misuse, or a security issue.
Accounts are personal to the registered user unless we expressly agree otherwise in writing. You may not share, sell, transfer, rent, sublicense, or provide access to your account, question banks, tutoring access, institution dashboard, or other Service features to another person.
The Service
OT Bestie provides educational tools for occupational therapy exam preparation and related learning support. The Service may include practice questions, tests, quizzes, lessons, interactive study materials, flashcards, podcasts, analytics, progress reports, study plans, pacing tools, notes, tutoring, customer support, institution access features, rewards, gift boxes, AI-assisted tools, and other features we make available.
We may add, modify, suspend, discontinue, limit, or remove any part of the Service at any time. We may also impose usage limits, storage limits, eligibility requirements, technical requirements, or access restrictions when needed for security, legal compliance, operational reliability, or product improvement.
Some features may be beta, experimental, or provided for testing. Beta features may be changed or discontinued without notice and may contain errors or limitations.
Educational Use, Exam Disclaimers, and No Guarantee
The Service is provided for educational and test-preparation purposes only. OT Bestie is not a school, university, credentialing body, licensing board, medical provider, legal advisor, financial advisor, or professional testing authority.
We do not guarantee that using the Service will result in passing the NBCOT® exam, achieving any specific score, obtaining licensure, employment, academic credit, or any other outcome. Your performance depends on many factors outside our control, including your background, study habits, exam-day conditions, and the official exam content and scoring standards.
OT Bestie is not affiliated with, endorsed by, sponsored by, or approved by NBCOT. NBCOT® is a registered trademark of the National Board for Certification in Occupational Therapy, Inc. Any references to NBCOT, OTR, COTA, or similar terms are for identification and educational description only.
Educational content may contain errors or become outdated. You are responsible for verifying important information through official sources, instructors, supervisors, licensing authorities, or qualified professionals as appropriate.
Fees, Subscriptions, Trials, and Cancellation
Some parts of the Service require payment. Prices, billing intervals, included features, trial periods, promotional offers, and cancellation rules are described at checkout or in the applicable plan materials. You agree to pay all fees, taxes, and charges associated with your purchase.
If you purchase a subscription, you authorize OT Bestie and our payment processor to charge your selected payment method on a recurring basis until you cancel or we terminate the subscription. Unless checkout states otherwise, subscriptions renew for the same billing interval at the then-current price plus applicable taxes.
You must cancel before the renewal date to avoid charges for the next billing period. You may cancel through account settings where available or by contacting us at contact@otbestie.com. Cancellation stops future renewals but does not automatically refund prior charges.
Free trials, discounts, coupons, or promotional offers may be subject to additional conditions, eligibility limits, and expiration dates. We may modify or withdraw offers at any time. If a trial converts to a paid subscription, you authorize us to charge the payment method on file when the trial ends unless you cancel before conversion.
Except where required by law or expressly stated in writing, fees are non-refundable. We may issue refunds, credits, or accommodations at our discretion, but doing so once does not require us to do so again. If you believe a charge was made in error, contact us promptly.
We may change pricing or subscription terms prospectively. For active recurring subscriptions, we will provide notice of material price changes as required by law or by the applicable payment platform.
Tutoring Terms
Tutoring is educational support and not therapy, medical advice, legal advice, academic counseling, mental health treatment, or a guarantee of exam performance. Tutors may help with study strategy, content review, question reasoning, pacing, confidence, and related preparation.
Tutoring availability depends on tutor schedules, holidays, demand, technical conditions, and eligibility. We may change tutors, scheduling tools, format, session length, package structure, or availability at any time.
Unless we state otherwise in writing, tutoring sessions are virtual. You are responsible for having a reliable internet connection, a working device, and a suitable environment. If you miss a session, arrive late, fail to provide necessary information, or cannot participate because of technical issues on your side, we may count the session as used.
Rescheduling and cancellation rules may be listed in the scheduling tool, purchase page, or confirmation email. Unless a different policy is stated there, you must request rescheduling at least 24 hours before the scheduled session. Late cancellations, no-shows, and unused credits may be forfeited.
We may record or document sessions for quality, training, safety, support, legal, or educational purposes where permitted by law and with required notices or consents. You may not record, redistribute, publish, or share tutoring sessions or tutor materials without our written permission.
Rewards, Points, Gift Cards, and Gift Boxes
Rewards, points, streaks, badges, gift boxes, gift cards, and promotional items are optional program features. They have no cash value, are not property, are not transferable, and may not be sold, exchanged, or redeemed except as we expressly allow.
We may adjust, limit, expire, suspend, substitute, or discontinue rewards at any time, including to correct errors, prevent abuse, manage inventory, comply with law, or improve the program. Reward availability, shipping areas, delivery timing, substitutions, and eligibility may vary.
You are responsible for providing accurate shipping information. We are not responsible for delays, failed delivery, lost packages, carrier issues, customs, taxes, or incorrect addresses outside our reasonable control. Gift cards and third-party rewards are subject to issuer terms.
We may revoke points, rewards, or access if we suspect fraud, abuse, automated activity, account sharing, chargebacks, eligibility issues, or other conduct inconsistent with these Terms.
Institution and Cohort Access
Institution, program, cohort, faculty, administrator, and group-access features may be governed by a separate written agreement between OT Bestie and the institution. If there is a conflict between these Terms and a signed written agreement, the signed agreement controls for that institution relationship.
If you access the Service through an institution, your institution may provide information about you and may receive information about your account, usage, progress, performance, support needs, or participation, subject to applicable law and the institution agreement. You authorize us to provide institution-related reporting where permitted by law, contract, and our Privacy Policy.
Institution administrators are responsible for ensuring they have the rights and consents needed to provide user information to OT Bestie and to receive reports or analytics about users. Institutions are responsible for their own FERPA, student-record, employment, procurement, accessibility, and related compliance obligations.
Payment Processing
Payments are processed by third-party payment processors, such as Stripe or other providers we use from time to time. We do not store complete payment card numbers on our own servers. Payment processors may collect, use, retain, and disclose payment information under their own terms and privacy policies.
You represent that you are authorized to use the payment method you provide. If a payment fails, is reversed, is charged back, or is suspected to be fraudulent, we may suspend or terminate access, seek collection, recover chargeback fees, and withhold credits or rewards to the extent permitted by law.
Acceptable Use
You agree not to misuse the Service or help anyone else do so. Prohibited conduct includes:
- Using the Service for unlawful, fraudulent, deceptive, harmful, harassing, defamatory, obscene, abusive, or infringing purposes.
- Sharing, publishing, selling, scraping, copying, harvesting, or redistributing questions, rationales, lessons, tutor materials, software, videos, screenshots, analytics, or other Service content.
- Using bots, scripts, crawlers, scrapers, automated tools, credential stuffing, data mining, load testing, or extraction methods without our written permission.
- Attempting to reverse engineer, decompile, bypass, interfere with, disable, overload, compromise, or access non-public parts of the Service.
- Using Service content to build, train, improve, benchmark, or validate a competing product, AI model, question bank, tutoring service, dataset, or commercial educational tool without our written permission.
- Uploading malware, malicious code, corrupted files, or content that violates another person's rights or privacy.
- Misrepresenting your identity, affiliation, exam status, institution relationship, or authorization.
- Using the Service as a competitor, on behalf of a competitor, or for competitive intelligence without our written permission.
- Circumventing account limits, paywalls, trial limits, rewards rules, geographic restrictions, security tools, or access controls.
- Engaging in conduct that could damage OT Bestie, our users, tutors, service providers, partners, or the public.
We may monitor usage, investigate suspected violations, limit access, suspend accounts, remove content, withhold rewards, or take legal action if we believe these Terms have been violated.
User Content, Feedback, and AI-Assisted Features
"User Content" means information, text, files, notes, prompts, answers, messages, reviews, feedback, images, recordings, or other content that you submit, upload, generate, or provide through the Service. You retain ownership of your User Content, subject to the rights you grant us in these Terms.
You grant OT Bestie a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, display, modify, create derivative works from, use, process, transmit, and disclose User Content as needed to provide, secure, support, improve, analyze, market, and operate the Service; enforce these Terms; comply with law; and protect rights and safety. This license continues as long as reasonably necessary for those purposes.
You represent that you have all rights needed to provide User Content and that your User Content does not violate law, these Terms, or any third-party rights. You are responsible for User Content and for decisions you make based on Service outputs.
We may provide AI-assisted features, automated feedback, generated study materials, chat, explanations, or recommendations. AI outputs may be inaccurate, incomplete, outdated, offensive, or similar to outputs provided to others. You should independently verify important information. Do not submit sensitive personal information, protected health information, confidential institution records, or third-party private information unless necessary and authorized.
If you submit suggestions, ideas, bug reports, feature requests, testimonials, reviews, or other feedback, you grant us the unrestricted right to use it without compensation or obligation to you.
Intellectual Property
The Service, including software, design, text, graphics, logos, icons, images, audio, video, questions, rationales, lessons, study plans, analytics, reports, tutor materials, compilations, workflows, trademarks, and other content, is owned by OT Bestie or our licensors and is protected by intellectual property and other laws.
Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your personal educational use or authorized institution role. We reserve all rights not expressly granted.
You may not copy, reproduce, distribute, publicly display, publicly perform, modify, translate, create derivative works from, sell, lease, sublicense, publish, extract, scrape, frame, mirror, or exploit any part of the Service except as expressly allowed by us in writing.
Privacy and Electronic Communications
Our Privacy Policy explains how we collect, use, disclose, and protect personal information. By using the Service, you acknowledge the Privacy Policy.
You consent to receive electronic communications from us, including account notices, security alerts, support messages, billing notices, tutoring updates, subscription notices, policy updates, marketing messages, and other Service communications. Electronic communications satisfy any legal requirement that communications be in writing.
If you provide a phone number, you consent to receive calls or text messages from OT Bestie or our service providers for account, support, tutoring, billing, security, and, where permitted, marketing purposes. Message and data rates may apply. You can opt out of marketing texts by replying STOP, but we may still send non-marketing messages where permitted by law.
Third-Party Services
The Service may use or link to third-party services, including payment processors, video conferencing providers, email providers, analytics services, advertising platforms, AI providers, hosting providers, app stores, shipping carriers, gift-card issuers, institution systems, or external websites. We do not control and are not responsible for third-party services. Your use of third-party services is governed by their terms and privacy policies.
Copyright Complaints
We respect intellectual property rights. If you believe material on the Service infringes your copyright, send a written notice to our Copyright Agent at contact@otbestie.com with the subject line "DMCA Takedown Request" or by mail to:

Your notice should include the information required by the Digital Millennium Copyright Act, including identification of the copyrighted work, identification of the allegedly infringing material and its location, your contact information, a good-faith statement, an accuracy and authority statement made under penalty of perjury, and your physical or electronic signature.
If you believe content was removed because of mistake or misidentification, you may send a counter-notice containing the information required by the DMCA. We may terminate accounts of repeat infringers where appropriate.
Suspension and Termination
We may suspend, limit, or terminate your access to the Service at any time, with or without notice, if we believe you violated these Terms, created risk or possible legal exposure, failed to pay fees, abused rewards, shared an account, misused tutoring, infringed rights, caused security concerns, or engaged in conduct harmful to OT Bestie or others.
You may stop using the Service at any time. Termination does not relieve you of payment obligations incurred before termination. Sections that by their nature should survive termination will survive, including payment obligations, intellectual property, User Content licenses, disclaimers, liability limits, indemnification, dispute resolution, and general provisions.
Indemnification, Disclaimers, and Limitation of Liability
Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless OT Bestie, our affiliates, service providers, licensors, tutors, officers, directors, employees, contractors, agents, and representatives from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the Service, User Content, violation of these Terms, violation of law, infringement or misappropriation of rights, payment disputes, institution obligations, or misuse of any Service feature.
Disclaimer of Warranties
We do not warrant that the Service will be uninterrupted, secure, error-free, virus-free, available at any particular time, compatible with every device or browser, or that defects will be corrected. We do not warrant that content, recommendations, AI outputs, tutoring advice, analytics, scores, or study plans will be accurate, complete, current, or suitable for your specific needs.
Limitation of Liability
To the fullest extent permitted by law, OT Bestie and the OT Bestie parties will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages; lost profits; lost revenue; lost data; loss of goodwill; business interruption; exam fees; lost opportunities; emotional distress; or substitute services, even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, our total liability for any claim arising out of or related to the Service or these Terms will not exceed the greater of (a) the amount you paid to OT Bestie for the Service giving rise to the claim during the six months before the event giving rise to liability, or (b) one hundred dollars ($100).
Some jurisdictions do not allow certain disclaimers or limitations. In those jurisdictions, the limitations apply only to the fullest extent permitted by law.
Dispute Resolution
Informal Resolution
Before filing a claim, you agree to first contact us at contact@otbestie.com and provide your name, account email, a description of the dispute, and the relief requested. We will try to resolve the dispute informally. If the dispute is not resolved within 60 days after notice, either party may proceed as described below.
Binding Arbitration
Except for small-claims matters, intellectual-property claims, unauthorized-access claims, or claims seeking injunctive or equitable relief, you and OT Bestie agree that any dispute, claim, or controversy arising out of or relating to the Service or these Terms will be resolved by final and binding arbitration administered by the American Arbitration Association under its applicable rules. The Federal Arbitration Act governs this arbitration agreement.
Arbitration will occur on an individual basis. The arbitrator may award relief only to the individual party seeking relief and only to the extent necessary to resolve that party's individual claim. The arbitrator may not consolidate claims or preside over any class, collective, representative, private attorney general, or mass arbitration proceeding unless all parties agree in writing.
Unless the arbitrator determines otherwise, arbitration will be conducted by video, phone, written submissions, or in Mecklenburg County, North Carolina. The arbitrator will have authority to decide issues of arbitrability, enforceability, and scope, except that courts will decide issues concerning the class action waiver.
Class Action and Jury Trial Waiver
To the fullest extent permitted by law, you and OT Bestie waive any right to a jury trial and any right to bring or participate in a class action, class arbitration, collective action, representative action, private attorney general action, or consolidated action.
Opt-Out
You may opt out of the arbitration agreement by sending written notice to contact@otbestie.com within 30 days after you first accept these Terms. Your notice must include your name, account email, and a clear statement that you opt out of arbitration. Opting out does not affect any other part of these Terms.
General Terms
These Terms and any additional terms incorporated by reference are the entire agreement between you and OT Bestie regarding the Service. If any provision is found unenforceable, the remaining provisions will remain in effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
These Terms are governed by the laws of the State of North Carolina, excluding conflict-of-law rules, except that the Federal Arbitration Act governs the arbitration agreement. For claims not subject to arbitration, you and OT Bestie consent to the exclusive jurisdiction and venue of the state and federal courts located in Mecklenburg County, North Carolina, or the federal district that includes that county.
You may not assign these Terms or your account without our written consent. We may assign these Terms, in whole or in part, without restriction. Our failure to enforce a provision is not a waiver. Headings are for convenience only. We are not liable for delay or failure caused by events beyond our reasonable control.
Any claim arising out of or related to the Service or these Terms must be filed within one year after the claim arose, unless a longer period is required by law.

Under California Civil Code Section 1789.3, California users may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, by telephone at (800) 952-5210, or as otherwise listed by the Department.
